Regulating Vending In Public Parks, Gardens & Beaches

393 stipulates that any person who desires to operate a business of selling goods or services in a public park, public garden or on a beach shall first obtain a licence for the purpose from the Commission. An application for a licence must be in writing on the prescribed form, addressed to the Manager of the National Conservation Commission. This application must be accompanied by the following: Police Certificate of Character, two recent testimonials, two references, and two passport-sized photographs.

It should be noted that this section also applies to a person carrying on any hotel, restaurant or other business, in respect of which there is in existence a valid licence granted under the Liquor Licence Act. 00, or imprisonment for a term of six months, or both. Further, the Commission wishes to advise all persons within this category to regularize their status by March 31, 2020, as failure to comply with these regulations may result in the enforcement of the aforementioned penalties and possible disruption to the operation of their business.

The Commission reserves the right to refuse to issue a licence if it is satisfied that the number of licensed vendors in a public park, garden or beach exceeds a limit determined by the Commission and approved by the Minister.
